141. Hi, We are at the final 'REGISTERED 2' stage and need to provide a contract example for RM6242 DPS. Is this supposed to differ from the contract examples provided at the previous stage? Can you provide more clarity on what type of example we need to provide here?
CCS can confirm that questions 133, 134, and 135 of the Standard Questionnaire (SQ) are not applicable for the Construction Professional Services DPS and that Suppliers should not complete these questions (please see 'READ FIRST RM6242 - DPS Needs_v4.0 document' and Selection Questionnaire - Not Applicable questions section on page 17.
Where a Contract Example is required in the DPSQ, we are asking for an example of a contract where you have delivered services similar to those you have ticked as able to provide in the filter matrix. You should describe the services provided in line with the DPSQ guidance. The letter of confirmation of services does not provide any further detail; it acts as confirmation of the contract between the supplier and the customer for CCS.

The bid pack documents 'Attachment 1a - Letter of Confirmation of Services (Contract Example 1)_v1.' and 'Attachment 1b - Letter of Confirmation of Services (Contract Example 1)_v1.0' are required for Questions 56 (Contract Example 1) and 60 (Contract Example 2) of the DPSQ. CCS can confirm that Contract Examples must be provided in line with the guidance in the DPSQ.

139. Hello, please can you advise: We have noted the request to provide information to complete the Selection Questionnaire 2016. As an SME Architecture business are we required to provide information to all the questions? For example questions 4 - 8 and many of the ISO certificates we do not hold. How do we respond as 'n/a'? does this disqualify us from being a supplier on the DPS?
CCS can confirm that a response is not required for all questions in the Selection Questionnaire 2016. Please refer to paragraph 73 of the DPS needs document of the bid pack for confirmation and details.
CCS has outlined the requirement to hold ISO 9001 and ISO 14001 under the standards section of the RM6242 Specification (section 5.1). This can be found under Attachment 7 of the bid pack in DPS Schedule 1 "Specification".
Suppliers must hold these accreditations in order to be appointed to this DPS.

138. Please can you confirm how bidders select the services they can deliver and whether it's acceptable to bid for individual services only (i.e. structural engineering).
Bidders will find questions relating to Technical and Professional Services beginning at question 74 of the Construction Professional Services DPS Questionnaire. You are advised to select only the relevant criteria to your organisation.

135. I am completing the Selection Questionnaire for the RM6242 Construction Professional Services. I can see from the guidance in the Read First document that for this framework, responses to questions 133 - 135 are not required, all relating to customer contracts. I am unclear what question 137 is trying to draw from us. Given 133-135 are not applicable to this contract, do we need to provide an explanation? If we do, are you able to provide examples of what this question is looking for? See the question below for reference. Any guidance would be much appreciated. If you cannot provide at least one example customer contract, in no more than 500 words please provide an explanation for this e.g. your organisation is a new start-up or you have provided services in the past but not under a contract.
You can enter 'N/A' for Question 137 in the Standard Questionnaire (SQ).

I understand from the clarifications that we can upload Letter of Confirmation of Services to Q58 but Q58 on the Construction Professional Services DPS asks: ' Please provide the following information for your second contract example for RM6242. Please highlight the relevant Filter sectors - service, industry sector, value band, location'. On the other Selection Questionnaire 2016 that I am also filling out, the questions skip from 21 to 104 so can't find Q58 to upload the letters. Can you clarify please?
The Letter of Confirmation of Services attachments should be uploaded as part of your DPSQ submission at Question 56 (first example) and Question 60 (second example). Please see the document titled 'SQ_DPS_PROFILE_CONSTRUCTION_SERVICES--v9' in the Bid Pack for an overview of all the questions.

131. Do you need a Carbon Reduction Plan to be admitted to this framework?
CCS can confirm that the completion and publication of a Carbon Reduction Plan is a mandatory requirement for DPS appointment where suppliers will be delivering contracts of over £5m in value. Please note PPN 06/21 references these plans for services with an anticipated contract value above £5m per annum (ex vat). Therefore, a Carbon Reduction Plan must be in place before appointment or you cannot select more than £5m on Q150 of the Construction Professional Services Questionnaire (DPSQ).

130. Can we amend the forms after they have been completed?
To be appointed to the DPS RM6242, there are two questionnaires involved in the application process: the Selection Questionnaire 2016 (SQ) and the Construction Professional Services Questionnaire (DPSQ).
Once you have progressed to the DPSQ stage, you will not be able to amend your responses to any of the SQ questions. If your organisation is successfully appointed to the DPS RM6242, you may update your answers and/or contact details for questions 53 onwards of the DPSQ.
Please note that responses in the following sections of the DPSQ cannot be changed after appointment: Equality and Diversity, Data Protection, Supplier Code of Conduct, Insurances, Cyber Security, Group of Economic Operators, Contract Termination, and Companies House Data (Questions 1-52).

We note that there are no questions in the SQ to confirm whether the potential suppliers are ISO 9001 & ISO 14001 certified however from the DPS Schedule 1 - Specification v1.0 it states the following: "5. Standards 5.1. The Supplier shall at all times for the duration of this DPS and the term of any individual call off contract, comply with the relevant standards for the scope of the services required which include; ● A Quality Management System supported by the International Organisation for Standardisation ISO 9001 Quality Management System, or the current European Foundation for Quality Management (EFQM) Excellence Model criteria or equivalent ● An Environmental Management System supported by the International Organisation for Standardisation ISO 14001 Environmental Management System or equivalent;" Please confirm if this means that suppliers who do not hold ISO 9001 & ISO 14001 certifications, would not be able to apply to be appointed onto the DPS? 128. We are currently looking at the CCS - Construction professional services DPS and have a few questions about the SQ. Please confirm if the questions within the SQ are the only questions to respond to, to be able to be appointed onto the DPS? We have not been able to locate any method statement questions within the documents provided in the Bid Pack. Please confirm if Question 154 from the SQ (about ISO 27001 and Cyber Essentials Plus) is a pass/ fail question? We are reading it as not being the case and that it will only be relevant for specific contract opportunities during competitions. Hello Jessica, the only information suppliers need to know in relation to Cyber certification is listed in the bid pack stating: You are required to confirm as part of your DPS submission, that you have
Cyber Essentials basic certification in place, as a minimum, at Question 155 of the SQ. If you have Cyber Essentials Plus you can select this option at Question 156 of the SQ. A 'Yes' response to either of these questions is
acceptable.
If you select 'No' to Question 155 of the SQ and confirm this response at
Question 5 of the DPSQ by selecting 'Yes' that you do not hold a valid Cyber Essentials basic certificate this will be classed as a 'Fail' and your application will be rejected until you have a valid Cyber Essentials basic certificate. You are required to comply with DPS Schedule 9 (Cyber Essentials) for the lifetime of your appointment to this DPS. I have completed the initial part of the DPSQ for the RM6242 Construction Professional Services DPS, but not yet submitted it, as I am seeking clarification on the T's & C's in the Appointment Form which include at 14) a £10,000,000 data protection liability cap. The associated insurance costs are a high bar for an SME (we have 10 employees only) and would preclude us from making our submission. We would be grateful for your urgent clarification as to whether this could be lowered for smaller companies.
DPS Terms and liabilities are set at DPS level and cannot be altered for specific organisations.

124. Good Afternoon, Our insurers have reviewed the various terms and conditions and we have a number of comments. Is there an option to negotiate any such amendments with you as we note we are only given the option to tick the box and confirm acceptance. Thank you
The terms and conditions of the DPS appointment cannot be changed, for example, all mandatory requirements (insurances etc.) must be met. These T&Cs are set at a CCS commercial agreement level and subject to government policies, for example, the requirement to hold a Carbon Reduction Plan if you plan to bid for projects of £5million +
However, clients (Buyers) using the RM6242 framework will issue a set of T&Cs for each call-off contract. CCS offer a number of forms of contract to our clients, for RM6242, Buyers can choose to apply the Public Sector Contract, NEC3, NEC4 or JCT forms of contract to their project.
Although Buyers may occasionally make minor amendments or add special terms, the contract documents should not be subject to change. This is to ensure the forms of contract remain industry standard for the benefit of both Buyers and suppliers.

122. I am completing our SQ for the Crown Commercial Services DPS. I am preparing our contract examples, and wondered if you could advise re: the following: 54. Please provide the following information for your first contract example for RM6242. If you are applying to provide services under only one service heading then you are required to supply one contract example. If you are applying to provide services under more than one service heading then you are required to supply 2 contract examples. By "service heading", does this refer to technical service, e.g., "architectural and design services", "civil and structural engineering services", "environmental engineering", "public health engineering", etc, or more granular (e.g., by sector / region.) We would be providing architectural and design services only, so I presume that is only one example? Please can you confirm?
The term 'service heading' is relating to the high level technical or professional service you are providing, such as Architectural and Design services / Civil and Structural Engineering services etc. If you only select one high level heading, such as Architectural and Design services, you need to provide one contract example. If you choose multiple high level headings, two contract examples are required.
