As we have Cyber Essentials Plus certification, which is a higher level than Cyber Essentials certification - would it be considered a Fail if we answered 'Not Applicable' to this question?
CCS can confirm if you select 'Not Applicable' to Q.4 of the DPSQ section of the Selection Questionnaire, as you have confirmed in Q.156 that your organisation has Cyber Essentials Plus certification, this would NOT be considered as a fail.

28. Q.155 - page 124/162 - Does your organisation have Cyber Essentials certification? Q.156 - page 124/162 - Does your organisation have Cyber Essentials Plus certification? We have Cyber Essentials Plus certification, which is a higher level than Cyber Essentials certification. Please clarify the evaluation criteria if we answer 'Yes' to Q.156 and 'No' to Q.155.
In accordance with clause 9 of the DPS Agreement, suppliers are required to have in place cyber essentials basic certification by the award of their first contract under the DPS Agreement. Please refer to the link below for further information re obtaining cyber essentials certification: https://www.cyberessentials.ncsc.gov.uk/getting-certified/ Customers will request copies of suppliers certificates prior to award of a contract under the DPS and in accordance with the obligations as set out in the DPS Agreement. If a supplier fails to provide the required certification, this may be deemed as a breach of contract and may result in a contract not being awarded. As your organisation has confirmed that you have Cyber Essentials Plus certification, selecting 'No' to Q.155 amd 'Yes' to Q.156 is acceptable.

Q.137- page 115/162 of Selection Questionnaire - If you cannot provide at least one example customer contract, in no more than 500 words please provide an explanation for this e.g. your organisation is a new start-up or you have provided services in the past but not under a contract. In the DPS Needs document page 9 it states that we need not answer Part 2 - questions 133, 134 and 135. Question: As Q.137 is related to133, 134 and 135, please confirm that we do not have to answer Q.137.
CCS can confirm Q.137 of the RM3824 HELGA DPS SQ is not applicable and a response to this question is therefore not required.

26. To submit our application to the DPS do we simply need to complete and submit the SQ available on the Supplier Registration Services website, or will there be further documentation/questionnaires specific to the HELGA DPS for us to complete return once the SQ is submitted?
In accordance with the DPS Needs document which forms part of the bid pack for RM3824, your organisation will be required to complete the Selection Questionnaire for RM3824 in full, successfully meeting all of the selection criteria to obtain a place on the RM3824 DPS.

25. Please can you advise if day rates are to be submitted at this stage, along with the completed questionnaire. We have reviewed the bid pack in full but cannot find any instruction on submitting framework day rates. Grateful for any direction you can provide on this.
CCS can confirm that the pricing and charging structure for RM3824 will be determined by the customer at competition stage, as detailed in DPS Schedule 3 - Charges.

22. Is the 'Contract End Date' the date when competition amongst the vendors will be closed?
The RM3824 DPS contract end date is the date the DPS platform will terminate. Please refer to the OJEU Contract Notice and the DPS Agreement (Clause 10) for further details relating to the DPS period.

21. Contracts Finder States: "N.B. Please be aware the dates input in the 'Closing Date' and 'Contract Start Date' have been revised to enable the opportunity to remain open on Contracts Finder. However, the 'Contract End Date' input is correct and is a true reflection of the contract end date for RM3824 - Heat Networks and Electricity Generation Assets (HELGA)." Can we please be advised where we can find the 'Contract End Date' and / or advise us what this date is?

20. Does the date of 13/11/2018 on page 10 of the 'DPS Needs' document represent only the date when the system will open for suppliers to compete within OR does it represent a last date by when a supplier must have completed their submission for assessment / acceptance onto the DPS for HELGA?"

The opportunity remains open at all times unless the DPS expires or is terminated in accordance with the DPS Agreement and as specified in the OJEU Contract Notice.

19. Is it possible to apply to HELGA later on, or will the framework be closed to new suppliers after the date in November when HELGA is open to buyers?

17. DPS Agreement. Clause 8.1 states "Where the Authority has notified the Supplier that the award of this DPS Agreement is conditional upon receipt of the execution of the first Contract the Supplier shall provide a valid DPS Guarantee , then on or prior to the execution of the DPS Agreement, as a condition for the award of this DPS Agreement, the Supplier must......" Could the CCS please clarify the wording? (ie, is the intended wording "Where the Authority has notified the Supplier that the award of this DPS Agreement is conditional upon receipt of a valid DPS Guarantee, then on or prior to the execution of the DPS Agreement, as a condition for the award of this DPS Agreement, the Supplier must......")
CCS can confirm clause 8.1 and 8.2 of the DPS Agreement for RM3824 has been amended. Please refer to the RM3824 bid pack in the marketplace for access to the DPS Agreement and the revised clauses .

16. DPS Agreement. Schedule 14 Insurance Requirements, Annex 1, Part B Professional Indemnity Insurance, Clause 8.1 stipulates a Maximum deductible threshold - "to be agreed with Supplier". The level of our excess on PI Insurance is confidential, and therefore cannot be disclosed. Can CCS please confirm this is acceptable.
CCS can confirm that appointed suppliers to the RM3824 HELGA DPS, may be required to confirm their maximum deductible threshold if requested by CCS at any point during the lifetime of the DPS Agreement.

15. The OJEU Notice states an estimated value of up to £20m in year 1 rising to a total potential value of up to e £800m excl VAT; the estimated value for each Service has not been completed. Can CCS to provide details of the methods and assumptions used to generated these estimated figures?
CCS can confirm, that the estimated spend value was generated using a wide range of publicly available information on expected future spend across the public sector. This also included extensive market engagement across the supply and customer base. We cannot put definitive figures on expected spend through each of the services given the flexible nature of the DPS agreement and the changing nature of the market.

14. Can you confirm whether it will be possible to add to the list of named sub-contractors at Stage 2?
Suppliers should list all known sub-contractors as detailed in DPS Schedule 7 (Sub-Contractors) of the DPS Agreement which forms part of the RM3824 bid pack. Suppliers are able to use different sub-contractors during the lifetime of their DPS Agreement, however any changes to sub contracting arrangements are subject to the obligations under clause 25.1 (Appointment of Sub-Contractors).

12. Do applicants bidding for a Service need to be able to demonstrate competence across the full list of technologies and services defined in the HELGA Filters Matrix?
Bidders will be required to demonstrate competence for the services which they have selected as part of their Selection Questionnaire submission. Customers (buyers) will specify such requirements as part of their statement of works at competition stage.

11. The HELGA Filters Matrix indicates a list of countries. Where is the service intended to extend to and is it the intention that services would be offered internationally?
CCS can confirm that services may be required internationally in one or more of the countries specified. However, exact details of such requirements will be determined by the customer (buyer) at competition stage. Therefore, bidders should ensure they only select the geographical location(s) for which they can provide the required products and/ or services.

10. Can CCS please further define the meaning of the terms Advisory, Design and Technical Services?
The term Advisory, Design and Technical Services comes from the Service heading Energy Advisory, Design and Technical Services and relates to all services which fall under this heading. CCS envisage these being used in areas such as energy consultancy, design of projects and technical advice on particular technologies. Essentially any activity which support energy generation or demand reduction exercises.
